Industrial Design Protection Registration

Industrial design refers to the external appearance of a product or a component that is assembled into a complex product, expressed through shapes, lines, colors, or a combination of these elements, and visible during the use of the product or complex product.Objects That Are Not Eligible for Industrial Design Protection:

• The external appearance of a product that is required due to the technical characteristics of the product;
• The external appearance of a civil or industrial building;
• The shape of a product that is not visible during the use of the product.

Vietnam follows the “first-to-file” principle, meaning that if two applications are submitted for the same industrial design that meets protection requirements, the design right will be granted to the first applicant.

Industrial design rights are initially protected for five years from the filing date and can be renewed twice, with each renewal extending the protection for another five years.
